ILLEGAL ARREST
The police need to have a legal basis to arrest you for Impaired Operation. If they are unable to explain sufficiently to a Judge at your trial, the court may refuse to admit your breath samples.
This area of law is very complicated and each arrest will have different considersations.

BREACH OF RIGHT TO COUNSEL
Once you are detained by the police, they have an obligation to put you in contact with your lawyer (counsel) of choice. If you ask to speak with Arvin Ross, the police MUST be diligent in contacting him. Otherwise it would be a breach of your rights that may result in your charges being dismissed.

IDENTITY OF DRIVER
If you were not in the driver’s seat of the motor vehile and didn’t
admit to being the driver, the Crown Attorney may not be able to prove that you were the driver of the vehicle. If they cannot prove this beyond a reasonable doublt, you will be acquitted (not guilty) after your trial.

NO INTENTION TO DRIVE
The Crown has to prove that you had Care or Control of your motor vehicle while occupying the driver’s seat. If you were in the car, but not for the purpose of diving it, we will be able to argue that you were not in Care or Control of the vehicle. If successful, you would be found not guilty of your DUI charge.

(Intoxilizer 8000c) LANGUAGE ISSUES
If English is not your first language, we will argue that special circumstances existed at the time of your arrest and the police were obligated to provide you with a translator, especially when speaking with your lawyer and giving instructions on how to blow into the breathalizer machine (Intoxilizer 8000c) if you are charged with refusing to provide a breath sample.
